1. License
bitMachina grants you a limited, non-exclusive, non-transferable license to access and use this website and its services for personal, non-commercial purposes, subject to these Terms. Any use outside this scope requires prior written consent.
2. Intellectual Property
All trademarks, logos, text, graphics, and software on this site are the property of bitMachina or its licensors and are protected by Canadian and international intellectual property law. Nothing in these Terms transfers ownership of any intellectual property to you.
3. Forbidden Activities
You may not use bitMachina services to launder money, finance terrorism, evade sanctions, or engage in any other unlawful activity. Attempting to structure transactions to avoid reporting thresholds, providing false identification, or using another person's identity is strictly prohibited and may be reported to law enforcement.
4. Cancellation / Termination
bitMachina may suspend or terminate your access to any service at its sole discretion, including where required by law, regulatory obligation, or suspected fraudulent or illegal activity. You may stop using the services at any time; certain recordkeeping obligations survive termination.
5. AML / CTF Policy
bitMachina maintains an Anti-Money Laundering and Counter-Terrorist Financing program consistent with FINTRAC requirements applicable to money services businesses in Canada. This includes customer identification, ongoing monitoring, recordkeeping, and reporting of suspicious transactions.
6. Daily / Order Limits
Transaction limits vary by verification tier and are described on our Fees & Limits page. bitMachina reserves the right to adjust limits at any time, including on a per-transaction or per-customer basis, for risk management purposes.
7. Sanctions List
bitMachina does not knowingly provide services to residents of, or persons located in, comprehensively sanctioned jurisdictions, currently including Iran, North Korea, Russia, Syria, Venezuela, Yemen, and Zimbabwe. This list may be updated to reflect changes in Canadian and international sanctions regimes.
8. Refund Policy
Due to the irreversible nature of cryptocurrency transactions, all sales are final. bitMachina cannot reverse a completed transaction once cryptocurrency has been sent to the specified wallet address.
9. Privacy, Consent & Data Collection
We collect personal information necessary to verify your identity, process transactions, and comply with legal obligations, including name, date of birth, address, government-issued ID, and transaction history. By using our services, you consent to this collection, use, and disclosure as described in this policy.
10. Third-Party ID Verification Vendor & Geolocation
We may share identity documents and geolocation data with third-party identity verification vendors to confirm your identity and detect fraud. These vendors are contractually bound to protect your information and use it solely for verification purposes.
11. Security Camera Notice
Physical bitMachina locations, including ATM and counter sites, may be monitored by security cameras for the safety of customers and staff and to support fraud investigations. Footage may be retained and shared with law enforcement where legally required.
12. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts of Ontario.
